Checklist for Compliance with Licensing Conditions
The further conditions are mandatory so you must ensure that you are in a position to comply with them all.
- Alcohol can be sold only in accordance with the Operating Plan contained in the licence.
- Any other activity is to be carried on only in accordance with the Operating Plan ie you cannot carry on an activity which you have not put in an approved Operating Plan.
- Alcohol cannot be sold if at any time
- There is no Premises Manager;
- The Premises Manager does not hold a Personal Licence;
- The Personal Licence held by the Premises Manager is suspended;
- The licensing qualification held by the Premises Manager is not appropriate.
- Every sale of alcohol must be authorised generally or specifically by the Premises Manager or by another person who holds a Personal Licence.
- All staff involved in making sales of alcohol or serving alcohol, whether paid or unpaid, must undergo training.
- A training record relating to staff who do not hold a Personal Licence but who are involved in the sale or service of alcohol must be kept in a prescribed form.
- They must have at least two hours training from a Personal Licence holder or from someone who has an accredited qualification.
- The items to be covered by training are covered by Regulation.
- Alcohol prices must be held for a 72 hour period.
- There must be no irresponsible drinks promotions.
- Tap water must be provided free of charge.
- Non-alcoholic drinks must be available for purchase at a reasonable price.
- The annual or recurring fee must be paid as required by Regulations.
- Alcohol which is for sale only for consumption off the premises may be displayed only in one or both of the following:-
- A single area of the premises agreed between the Licensing Board and the licence holder; or
- A single area of the premises which is inaccessible to the public.
- In any area agreed with the Licensing Board only non-alcoholic drinks or products packaged which may be purchased only with alcohol may be displayed with the area.
- For on sales premises there must be displayed a Notice of at least A4 size stating either that persons under the age of 18 are not permitted on the premises or that such persons are permitted on the premises or such parts of the premises as are specified on the sign.
- For premises which are not used mainly as a Club and to which children under the age of 5 are to be admitted there must be facilities for baby-changing which are accessible to persons of either gender.
If you operate late night premises (after 1 am and you are not one of the permitted exclusions ie Hotels, restaurants, theatres, cinemas and art galleries) and the capacity of your premises is at least 250 people and you regularly provide at any time between 1 am and 5 am the following:
- Live or recorded music exceeding 85 decibels;
- Facilities for dancing; or
- Adult entertainment; or
- When fully occupied are likely to have more customers standing than seated
THEN
- you must have a person trained in administrating First Aid present on the premises from 1 am until the premises close (or 5 am if earlier);
- have a Personal Licence holder present on the premises from 1 am until the premises close (or 5 am if earlier);
- have a written policy concerning:
- the evacuation of the premises, and
- the prevention of the misuse of drugs on the premises.
- a CCTV system installed in good working order;
- have persons responsible for checking on the safety and wellbeing of persons using any toilet facilities;
- a person who holds a licence under the Private Security Industry Act 2001 positioned at every entrance to the premises from 1 am until the premises close or 5 am, whichever is the earlier.
In addition to the mandatory conditions your Board may impose other conditions at their discretion. Please refer to their policy documents for guidance on the Board’s policy and other matters which they may expect licence holders to comply with.
